5 Year Limited Warranty on all Hitches
2 Year Limited Warranty on all Air Pin Box
(For all products sold after 1/1/06)
Air Hitch Technology warrants its products against defects in material and workmanship under normal use and service, ordinary wear excepted, to the original owner for a period of five (5) (2 years for Air Pin Box) year from date of purchase by the original purchaser. The warranty covers all air safe hitches for 5 years not including accessories.
Air Hitch Technology and its distributor’s entire liability and your exclusive remedy shall be, at Air Hitch Technology sole option. Either (a) return of the original purchase paid price, or (b) repair or replacement of any part that does not meet Air Hitch Technology Limited Warranty and which is presented to any Air Hitch Technology dealer, Air Hitch Technology warehouse, or returned to the factory, with a copy of your receipt. Transportation charges must be prepaid to the return any air hitch product to the locations noted above. THIS LIMITED WARRANTY IS LIMITED TO DEFECTIVE PARTS AND REPLACEMENT ONLY, LABOR CHARGES AND/OR DAMAGES INCURRED DURING INSTALLATION OR REPLACEMENT OR EXCLUDED.
Any damage to the trailer hitch or any part as a result of misuse, abuse, neglect, accident, misapplication, improper installation, or any violation of instructions furnished by us, VOIDS THE LIMITED WARRANTY.
NO OTHER WARRANTIES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIR RIDE AND ITS DISTRIBUTORS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE CUSTOM TRAILER HITCHES. THIS LIMITED WARRANTY FIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES, TO MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIR HITCH TECHNOLOGY OR ITS DISTRIBUTORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS, ARISING OUT OF THE USE OF OR INABILITY TO USE THE TRAILER HITCHES, EVEN IF AIR HITCH TECHNOLOGY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCISION OR LIMITATIONS OF LIABILITY FOR ONCSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
The owner has available the legal remedies provided by the Magnusson-Moss Warranty Act, Public Law 93-637, 99 STAT.2183-2193: 15 U.S.Code, Secs 23021-2312, and any applicable state statutes.
